Des Moines Personal Injury Law

Providing empathy throughout your personal injury case

When an individual is injured or dies because of the negligence of another party, that party is liable for the damages caused to the individual and the individual's family. In these cases the medical expenses have a specific price tag. The physical, psychological, and emotional suffering of the family involved does not. We will work to bring justice to the party at fault, get fair and just compensation for the hardship of the victim(s), and provide what solace we can to the family of the victim.

How we can help:

Our Des Moines personal injury law firm is experienced in a wide variety of matters concerning negligence and malpractice leading to injury:

  • Alcohol-related Accidents

  • Animal Bites/Attacks

  • Assault/Battery

  • Truck, Car, and Motorcycle crashes

  • Bicycle Accidents

  • Boating Accidents

  • Construction Site Injuries

  • Fires/Explosions

  • Nursing Home Neglect/Abuse

  • Pedestrian Accidents

  • Premises Liability

  • Train And Railroad Accidents

  • Workplace Injuries

Boating Accidents: Being an operator of or passenger in a boat can be dangerous, especially around other boats. Without the protection provided by a motor vehicle, boaters can suffer significant injuries even in a low-speed collision, accident, or capsize event. Boating accidents can leave victims with severe physical consequences, such as severe cuts and lacerations, bone fractures, traumatic brain injuries, spinal cord damage, and perhaps wrongful death, including by drowning. Boat operators who cause accidents may be responsible to their victims for compensatory and punitive damages. Boating injuries are commonly caused by: (1) boat operators who do not have enough experience or training to operate their boat; (2) operating a boat while under the influence of drugs or alcohol; (3) an insufficient number of life jackets; (4) generally unsafe, negligent, or reckless operation of the boat, such as failing to keep a proper lookout or speeding; and (5) other missing or nonfunctional safety equipment.

Fires and Explosions: Many different events can cause fires and explosions, including dangerous products such as equipment, electrical wiring, space heaters, and other types of appliances; airplane and helicopter accidents, industrial fires and explosions; grain bin fires and explosions, car, truck, and motorcycle accidents; and propane and natural gas leaks. Fires and explosions can cause devastating and even deadly injuries from collapsing structures or flying debris in addition to burns. They can also lead to significant property damage claims and battles with your property insurance company.

Explosion and fire lawsuits demand careful investigation and attention. The medical issues stemming from a fire or explosion can be complex. The cause of the fire or explosion also has to be identified to decide which parties may be held responsible. That almost always involves the use of expert witnesses. Our firm is experienced in working with fire inspectors and marshals, human factors and materials experts, product experts, and electrical and chemical engineers, all of whom have assisted with identifying the origin or cause of a fire.

Pedestrian and Bicycle Accidents: Pedestrians and bicyclists face significant risk when on the road with motor vehicles. Without the protection provided by a motor vehicle, bicyclists can suffer significant injuries even in a low-speed collision. Bicycle accidents can leave victims with severe physical consequences, such as traumatic brain injuries, spinal cord damage, and perhaps wrongful death. Bicycle injuries are commonly caused by motorists who: (1) ignore the rules of the road or engage in aggressive driving; (2) fail to pay attention while driving; (3) drive recklessly or with excessive speed, especially in areas where many cyclists are located; (4) ignore lower speed limits and fail to keep an increased lookout in special safety areas, such as school zones and construction zones; and (5) fail to yield to cyclists or grant cyclists the right of way.

What are my rights to monetary compensation?

Iowa law provides strong remedies for personal injuries or wrongful death. You may be able to recover money damages for, among other things, past and future medical expenses, past and future physical and mental pain and suffering, and past and future disability or loss of function of the body.

If the accident caused a death, an additional series of money damages for wrongful death may also be applicable. Families who have lost a loved one because of a wrongful death may be entitled to recover money damages for medical expenses, funeral and burial expenses, loss of consortium, and the value of the money the loved one would have earned if he or she had lived.
